Management Services Contract Dispute: The InHealth team assisted a national physician-led health system in its defense of breach of contract claims related to an agreement for professional and management services provided by a multispecialty physician group. InHealth helped its client secure a jury verdict for over $16 million in damages on its counterclaims.
Federal False Claims Act Defense: An InHealth team member served as an expert witness in a health system’s defense of its purchase of a radiation oncology center. Fair market value and commercial reasonableness opinions prepared by InHealth team members resulted in all claims related to the transaction being dropped.
Civil Investigative Demand Support: InHealth personnel worked collaboratively with counsel and health system personnel to provide fair market value and commercial reasonableness opinions related to an emergency medicine physician compensation plan. Work done by the InHealth team member was instrumental in the government’s decision not to intervene in a related qui tam complaint.
Federal False Claims Act Defense: InHealth guided an orthopedic surgery practice in its successful defense of a qui tam complaint alleging improper physician compensation, as well as inappropriate surgery center buy-in transactions. InHealth provided FMV and commercial reasonableness opinions related to the physician compensation plan, as well as rebuttal of a competing expert’s analysis regarding the surgery center transactions.
Indian Health Services Funding Dispute: An InHealth team member assisted a Tribal-run health system in developing an analysis of the regional economic impact of the system’s healthcare services as part of a dispute relating to funding from Indian Health Services. The client was able to secure a nine-figure settlement from Indian Health Services to resolve historical underfunding of key healthcare services.
